These Terms & Conditions (“Terms”) govern your access to and use of Eagle Eye services, mobile app, and any other products or services offered by Eagle Eye (collectively, the “Service”). By using the Service you agree to be bound by these Terms. If you do not accept these Terms, do not use the Service.
Eagle Eye is a safety intelligence network that promotes personal and family safety, provides real-time reports and security services primarily with its mobile app and website through a combination of verified partners across Nigeria. By using our Services - You agree that you understand our Service.
1. Definitions
- "Eagle Eye", "we", "us", or "our" refers to Techsoft Studio Limited, including its resources, affiliates, operators, and all related services.
- "Services" refers to all products, solutions, mobile applications, and technologies provided by Eagle Eye.
- "Device" refers to any mobile or handheld device used to access the Services, including but not limited to mobile phones, tablets, and smart wearables.
2. Acceptance of Terms
These Terms, together with our Privacy Policy and any additional agreements for specific services, constitute the entire agreement between you and Eagle Eye. If you do not agree to all the terms and conditions, you may not access or use the Services. By using the Services, you represent and warrant that:
- You are at least 18 years of age and have the legal capacity to enter into these Terms.
- You are solely responsible for ensuring you have the legal right to track or monitor any device added to the Services.
- You will use the Services only for lawful purposes and in accordance with these Terms.
- You will not use the Services in any manner that could harm, disrupt, or impair the functionality or security of the platform.
- You will not attempt to gain unauthorized access to any part of the Services, systems, or networks connected to the platform.
- You will only link devices legally owned by you, or for which you have proper authorization, may be linked to our network.
- You agree that the Services may use GPS, network location, and SMS-based triggers to locate devices.
- You understand that location accuracy often depends on device settings, network coverage, proximities and environmental factors.
3. Scope of Services
Eagle Eye provides a range of services aimed at enhancing personal and family safety. The scope, features, and functionality of the Services may be modified, expanded, or restricted at any time at our sole discretion. The Services we provide include, but are not limited to:
- Device Safety & Protection.
- Family Safety Solutions.
- Threat and Location-Based Reports.
- Personal Safety Solutions.
- Subscription-Based Services.
- Location Intelligence.
- Physical Goods and Services.
4. User Responsibilities
By using Eagle Eye, you agree to grant the necessary device permissions and to use the Services in accordance with these Terms. If you do not directly use Eagle Eye but access certain parts of the Services - such as device tracking or viewing safety reports via the website - you agree to act responsibly, comply with all applicable laws, and ensure that your use of the Services is lawful, safe, and not intended to create negative publicity.
5. Prohibited Conduct
Eagle Eye operates its Services under a policy of fairness with the aim of promoting safety. By using our Services, you agree not to engage in any of the following conduct:
- Violate any applicable laws or regulations in Nigeria or any other jurisdiction.
- Track or monitor any person or device without their knowledge and consent, where required by law.
- Harass, stalk, threaten, or harm any individual.
- Transmit any harmful code, viruses, or malicious content.
- Engage in any illegal, fraudulent, or unethical activity.
- Reverse engineer, decompile, or attempt to extract the source code of the Services.
- Use the Services for mass surveillance or unauthorized monitoring.
- Use automated scripts, bots, or other tools to access the Services without authorization.
6. Intellectual Property
All content provided by Eagle Eye, including the platform, software, designs, text, logos, graphics, and other materials, is owned by Techsoft Studio Limited or its licensors.
- Users may not copy, modify, distribute, or create derivative works from Eagle Eye content without prior written permission.
- Any content you submit remains your property, but you grant Eagle Eye a non-exclusive, royalty-free, worldwide license to use, display, and distribute it for the Services.
- You represent and warrant that your content does not infringe upon the intellectual property rights of any third party.
- Some content, including images or media, may be sourced from third parties. Eagle Eye uses such content under license or fair use, but does not claim ownership of third-party materials.

If you believe that any content or material available through the Eagle Eye Service infringes your intellectual property rights (including copyright, trademark, or patent), you must submit a valid written takedown notice to us.
A valid notice must clearly include:- Your full name, contact details, and signature (physical or electronic);
- Identification of the intellectual property right claimed to be infringed;
- Sufficient information to locate the allegedly infringing material on the Service;
- A statement that you have a good faith belief that the use of the material is not authorized by the rights owner, its agent, or the law;
- A declaration that the information in the notice is accurate and that you are authorized to act on behalf of the rights owner.
Upon receipt of a complete and valid takedown notice, we will review and respond, which may include removing or disabling access to the allegedly infringing material.
We are not obligated to act on incomplete, anonymous, or improperly formatted complaints. Repeated violations may result in account termination and/or legal action.
7. Third-Party Services
The Services may integrate or interact with third-party services, platforms, or content. Your use of these third-party services is subject to their own terms, conditions, and privacy policies. By using the Services, you acknowledge that Eagle Eye is not responsible for the practices of any third-party services.
8. Modifications to Service
Eagle Eye reserves the right to modify, suspend, or discontinue any aspect of the Services at any time, including features, functionality, content, or availability, without prior notice.
We do not guarantee that all Services will be continuously available, error-free, or compatible with all devices. Your continued use of the Services after any modifications constitutes your acceptance of those changes.
9. Subscriptions
EagleEye offers an optional subscription-based model that unlocks advanced features and controls within our mobile application. Our subscriptions operate on a pay-as-you-go basis, meaning you are not automatically charged or billed on a recurring basis. Users are responsible for renewing it upon expiration.
- Subscriptions are linked to individual devices.
- Subscription plans are flexible and may vary.
- All subscriptions are charged in Nigerian Naira (₦).
- Subscriptions may be suspended or terminated if you violate our Terms.
- Subscriptions are non-transferable.
10. Refunds & Cancellations
Eagle Eye offers most of its Services free of charge. However, if you have an upgraded account and is not satisfied with our Service, refunds may be requested as follow:
- Monthly: Within 7 days of the initial payment.
- Annual: Within 30 days of the initial payment.
To request a refund, contact Eagle Eye support with your subscription details. Refunds will be processed to the original payment method. After the applicable refund period, all subscription fees are non-refundable. Cancellation of an active subscriptions will incur a flat 10% charge.
11. Termination
Eagle Eye may terminate your access to the Services, in whole or in part, at any time without prior notice if you violate these Terms or engage in prohibited conduct.
- Termination may be immediate or after notice, depending on the nature of the violation.
- Upon termination, your right to access and use the Services will immediately cease.
- Any outstanding fees prior to termination shall be deemed waived and will no longer be payable upon termination of the Services.
- Eagle Eye reserves the right to remove or delete any content associated with terminated accounts.
12. Disclaimer of Liability
To the maximum extent permitted by applicable law, Eagle Eye provides the Services on an "as is" and "as available" basis. We do not make any warranties or representations, express or implied, regarding the accuracy, reliability, availability, or completeness of the Services.
- We do not guarantee 100% uptime, location accuracy, or uninterrupted service.
- We are not responsible for any damages, losses, or harm resulting from your use of the Services, including decisions made based on reports or information provided through the Services.
- The Services may include links to third-party websites or services, over which we have no control and assume no responsibility.
- Any data you share through the Services is subject to our Privacy Policy and the terms of any third-party services you interact with.
- Your use of the Services is at your own risk. Users must exercise their own judgment and follow official security advisories.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Eagle Eye shall not be liable for any claims, damages, or losses arising out of or in connection with your use of the Services, including:
- Indirect, incidental, special, consequential, or punitive damages;
- Loss of profits, revenue, data, or opportunities;
- Damages resulting from errors, omissions, interruptions, defects, delays, or failures in the Services; or
- Service interruptions due to network failures, natural disasters, or force majeure events.
Our total liability for any claims arising out of or related to the Services shall not exceed the greater of (A) the amount you paid to us in the twelve (12) months preceding the claim, or (B) NGN 100,000.
14. Indemnification
You agree to indemnify, defend, and hold harmless Techsoft Studio Limited, Eagle Eye, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the Services, violation of these Terms or applicable laws;
- Any content you submit, post, or transmit through the Services;
- Your violation of any applicable law, regulation, or third-party rights; or
- Any actions that cause harm or disruption to the Services or other users.
Eagle Eye reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with our defense of these claims.
15. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal data and device information. By accessing or using the Services, you acknowledge and consent to the practices described in our Privacy Policy.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute, legal actions or proceedings arising out of or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the competent courts of Nigeria.
17. Changes to Terms
We reserve the right to modify the Services or these Terms at any time. Where material or operational changes are made, we will provide reasonable notice. Your continued use of the Services following such modifications constitutes your acceptance of the updated Terms.
